India’s Ministry of Home Affairs has notified the Immigration and Foreigners (Amendment) Rules, 2026, easing the timeline for stay-extension registration while tightening conditions for late filing. The amendments take effect immediately, issued through an official Gazette notification on Monday under Section 30 of the Immigration and Foreigners Act, 2025.
Under the new framework, foreigners wishing to stay longer in India can now complete their registration “any time before the expiry of 180 days” from arrival. The earlier provision had required registration within 14 days after the 180-day window lapsed. Registration beyond the prescribed period will be permitted only under “emergent circumstances,” the amendment states.
The rules also clarify treatment of children. Where either parent is an Indian citizen and wishes to retain the child’s Indian citizenship under the Citizenship Act, 1955, the registration requirement will not apply. Where a child acquires foreign citizenship while in India, either parent must inform the Registration Officer within 30 days. Reporting timelines under certain provisions have been rationalised to a 24-hour compliance window.
A fully digitised appeals process has been introduced. Individuals aggrieved by directions issued by civil authorities can file appeals before the Commissioner, Bureau of Immigration, within 30 days through a designated online portal. The Commissioner must endeavour to pass a reasoned order within 60 days of receipt, after granting a hearing.
Officials cited by ANI/Khaleej Times said the amendments are part of a broader modernisation of India’s immigration framework, balancing facilitation for genuine cases with stricter conditions for delayed compliance. The framework directly affects Sri Lankan nationals travelling to India for study, work, medical treatment or family visits beyond the standard tourist window, a substantial flow underscored by the India–Sri Lanka business ties strengthened at the Mumbai forum in May.
